These terms cover how Momor works, what we promise you, and what we ask in return. The gist:
- Use the service however it fits your workflow — anonymously or with an account, by text or by uploading images
- We'll do our best — to give you accurate, helpful answers from real sources
- Use it like a reasonable person would — and we'll never have a problem
- If something goes wrong — we've got fair processes for sorting it out
The details are below. We tried to write them like humans.
1. Agreement to Terms
By using Momor ("Service"), operated by Momor.ai LLC ("Company," "we," "us," or "our"), you're agreeing to these terms. If something here doesn't work for you, that's okay — but you shouldn't use the Service in that case.
2. Description of Service
Momor is a judgment-aware orchestration system for complex workflows. The Service includes Momor Search, which provides grounded outputs through third-party data sources and AI-generated processing, along with anonymous access, paid subscription tiers, and enterprise deployments for organizations.
2.1 Search Methods
The Service supports multiple ways to search:
- Text search: Enter keywords or questions to find information
- Visual search: Upload an image to search based on its contents, identify objects, people, places, or text within images
- Reverse image search: Upload an image to find where it appears online, verify its origin, or fact-check claims about what it depicts
- File analysis: Upload supported files for AI-powered analysis and information extraction (additional file types coming soon)
Currently supported upload formats: JPEG, PNG, GIF, WebP, HEIC. Maximum upload size and supported formats may change over time.
2.2 Conversational Search and Threads
The Service supports multi-turn conversations where follow-up questions build on previous context within the same thread.
- Saved threads: When you are signed in, conversation threads are saved to your account by default. Saved threads persist until you delete them. You can view, continue, or delete saved threads at any time from your account.
- Incognito mode: You can use incognito mode to search without saving. Incognito conversations exist in short-lived cache (typically 30 minutes) and are not stored permanently. Once the cache expires, the conversation is gone and cannot be recovered.
- Anonymous users: Conversations for users who are not signed in are always temporary and follow the same short-lived cache behavior as incognito mode.
2.3 Enterprise Access
We offer enterprise deployments with dedicated tenant isolation, configurable AI provider routing, and compliance controls. Enterprise access is governed by a separate Enterprise Agreement in addition to these Terms. Where the Enterprise Agreement conflicts with these Terms, the Enterprise Agreement controls for the enterprise customer's use.
2.4 Usage Limits and Quotas
To keep the Service fast and sustainable, we may apply usage limits and quotas tied to your account, subscription tier, or connection (for anonymous use). These limits are typically measured over rolling time windows (for example, per 24-hour period) and may vary between anonymous access and paid tiers (Basic, Pro, and Max).
Current limits and behaviors by tier are described in our pricing and product documentation and may change over time. If you exceed applicable limits, the Service may temporarily reject requests, return quota-related errors, or ask you to wait, sign in, or upgrade your plan. Attempting to circumvent these limits violates these Terms (see Section 6.6).
2.5 No Obligation to Continue
You may stop using the Service at any time, for any reason, without notice to us. If you have an account, you may delete it through your account settings. If you have an active paid subscription, you may cancel it at any time as described in Section 12.3; cancellation is entirely at your discretion.
3. Eligibility
You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
3.1 Children's Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it and terminate the account. Parents who believe their child has provided us information may contact support@momor.ai.
4. User Accounts
4.1 Account Creation
- You may browse the Service anonymously or create an account for additional features
- You may also create an account using a third-party service like Google or Apple. Your use of such third-party services is subject to their respective terms and policies.
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
4.2 Account Termination
- We may suspend or terminate your account for violations of these Terms
- You may delete your account at any time through the account settings
- Upon account deletion, your account data will be removed within 30 days
- Some information may be retained as required by law or for legitimate business purposes
- We may also temporarily suspend your account, restrict access to certain features, or block access to the Service by IP or other technical means where we reasonably suspect fraud, abuse, or security risks, or where we are required to do so by law, regulation, court order, or governmental authority.
- For non-urgent actions, we will use reasonable efforts to provide advance notice (for example, via email or in-product notification) before suspension or termination takes effect and will describe, in general terms, the reason for our action.
- We may act without prior notice where continued access poses serious security, fraud, abuse, or safety risks, or where advance notice is prohibited or impracticable due to legal requirements or law-enforcement requests.
If we terminate your paid subscription or account for reasons not caused by your breach of these Terms, you may be eligible for a pro-rated refund of any prepaid, unused subscription fees as described in Section 13.
5. Privacy and Data Collection
5.1 Privacy Policy
Our Privacy Policy is incorporated by reference into these Terms and governs our collection, use, and disclosure of information. If these Terms conflict with the Privacy Policy on a privacy topic, the Privacy Policy controls.
5.2 No Sale/Share; No Behavioral Ads
We do not "sell" or "share" Personal Information as those terms are defined under the California Consumer Privacy Act (as amended by CPRA) and analogous state laws. We do not engage in cross-context behavioral advertising, interest-based advertising, retargeting, or cross-site tracking.
5.3 Contextual-Only Ads (If Shown)
If we show ads, they are strictly contextual—selected solely based on the current page content or the immediate query you just entered ("Per-Request Context"). We do not retain Per-Request Context for future ads, link it across sessions, or combine it with off-site activity. Paid tiers do not see ads.
5.4 Logs and Retention
We minimize and expire data quickly:
- IP addresses are truncated at collection and stored separately from queries
- Session correlation IDs rotate at least every 24 hours
- Application logs containing query metadata are retained for up to 30 days, then deleted or irreversibly de-identified
- Feedback datasets (query + returned results + ephemeral correlation ID) are retained up to 30 days solely to diagnose quality issues, then deleted
- Uploaded images and files are marked for deletion after 30 minutes; in rare cases, cleanup may take up to 24 hours
- Ephemeral conversation threads expire from cache within 30 minutes and are not stored permanently
- Saved conversation threads are stored in your account until you delete them; upon deletion, they are removed within 30 days
5.5 Anonymous and Unauthenticated Use
Anonymous users are not associated with persistent identifiers and are never tracked for advertising or profiling. Anonymous session data is processed only to operate the Service and is deleted per §5.4.
5.6 AI Training Prohibition (Our Systems and Vendors)
We do not use your queries, uploads, feedback, or other user content to train machine learning models. For our AI vendors, we actively select only those whose terms of service prohibit them from using customer data to train their own models.
5.7 User Controls
You may access, export, and delete your account information through account settings. Upon verified deletion, we delete active copies within 30 days and remove from backups within 90 days, except where retention is required by law. We honor Global Privacy Control (GPC) signals.
5.8 Government Requests
We will notify you of any governmental or law-enforcement request for your information prior to disclosure, unless legally prohibited, and will only disclose the minimum necessary to comply with law.
5.9 Security
We implement reasonable administrative, technical, and organizational safeguards appropriate to the nature of the data, including encryption in transit and at rest, least-privilege access, and vulnerability management. If we determine a breach of security has likely resulted in risk to you, we will notify you without undue delay and in accordance with applicable law.
5.10 Data Residency
Personal Information is stored in the United States. For transfers to users in the European Economic Area or United Kingdom, we use appropriate safeguards such as Standard Contractual Clauses.
6. Acceptable Use Policy
We designed these rules to protect users and the Service from abuse. Normal, good-faith use of Momor—even when you disagree with results or explore sensitive topics—does not violate these Terms.
You agree not to use the Service to:
6.1 Illegal Activities and Harmful Content
- Violate any applicable laws or regulations
- Search for, access, or promote content depicting child sexual abuse or exploitation
- Facilitate or promote terrorism, violence, or physical harm to any person or group
- Search for information to commit crimes, including but not limited to fraud, identity theft, or violent acts
- Promote or coordinate illegal drug trafficking or sale of controlled substances
- Search for or share information about manufacturing weapons, explosives, or other dangerous materials
6.2 Hate Speech and Discrimination
- Promote hate speech, discrimination, violence, or harassment against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Use the Service to coordinate harassment campaigns, doxxing, stalking, or targeted abuse
- Search for or promote content from known hate groups or extremist organizations
- Attempt to use the Service to radicalize others or spread extremist ideologies
6.3 AI System Manipulation and Abuse
- Attempt to manipulate AI responses through prompt injection, jailbreaking, or similar techniques
- Try to circumvent content filters, safety measures, or usage restrictions
- Attempt to extract training data, model weights, or proprietary information from AI systems
- Use the Service to generate content that violates these Terms through indirect methods or role-playing scenarios
- Attempt to make the AI system provide instructions for illegal activities by framing requests as hypothetical, educational, or fictional
6.4 Misinformation and Deception
- Deliberately spread false information about public health, elections, disasters, or other critical topics
- Impersonate others or misrepresent your identity or credentials
- Use the Service to create or spread deepfakes, manipulated media, or other deceptive content
- Submit false feedback, reports, or reviews to manipulate service quality or rankings
6.5 User-Generated Content and Identity
- Create usernames, display names, or profile content containing hate symbols (swastikas, confederate flags, etc.), slurs, or references to extremist groups
- Use usernames or profiles that sexualize minors, promote violence, or contain explicit sexual content
- Create accounts with names designed to evade content filters or previous bans
6.6 Technical Abuse and System Interference
- Exceed the usage limits specified in our pricing and service tiers as published on our website, subject to modification at our discretion
- Use automated scripts, bots, crawlers, or scraping tools to access the Service, regardless of whether access patterns mimic human behavior, unless expressly authorized in writing by the Company
- Attempt to gain unauthorized access to our systems, user accounts, or restricted areas
- Overwhelm our servers through denial-of-service attacks or similar methods
- Reverse engineer, decompile, or attempt to extract the Service's algorithms or source code
- Interfere with or disrupt the Service's infrastructure, security measures, or other users' access
- Upload malicious files, malware, zip bombs, or files designed to exploit vulnerabilities in our systems or our providers' systems
6.7 Commercial and Competitive Abuse
- Use the Service for large-scale commercial data harvesting without written authorization
- Resell, redistribute, or commercialize search results or AI-generated content without permission
- Use the Service to build competing search engines or AI systems
- Use the Service to create training datasets, evaluation benchmarks, synthetic data, or any derivative data products
- Reverse engineer our search algorithms, ranking signals, or AI capabilities through systematic querying
- Violate robots.txt files or website terms of service when accessing content through our Service
6.8 Privacy Violations and Surveillance
- Use the Service to conduct unauthorized surveillance or monitoring of individuals
- Search for or attempt to access private personal information without consent
- Use the Service to facilitate identity theft or unauthorized access to accounts
- Attempt to correlate search patterns with individual identities for tracking purposes
6.9 Prohibited Uploads
When using visual search, reverse image search, or file upload features, you agree not to upload:
- Child sexual abuse material (CSAM) or any sexual content involving minors
- Non-consensual intimate images ("revenge porn") or any intimate images of individuals who have not consented to their distribution
- Content that violates others' intellectual property rights where you lack authorization
- Malware, viruses, or files designed to damage or exploit systems
- Classified, export-controlled, or legally restricted materials
- Content depicting illegal acts for the purpose of facilitating those acts
A simple test: If you'd have second thoughts about your mama seeing it, maybe don't upload it.
Surveillance and Tracking via Uploads: Do not use image or file uploads to identify, locate, or track private individuals without their consent. This includes but is not limited to: attempting to locate someone who has distanced themselves from you, identifying individuals for purposes of stalking or harassment, or circumventing someone's choice not to be found. Searching for publicly available information about public figures is permitted.
6.10 Account and Service Abuse
- Create multiple accounts to evade restrictions, bans, or usage limits
- Share, sell, transfer, sublicense, or otherwise provide access to your account credentials; allow unauthorized access to your account; or accept payment or other consideration for access to your account or the Service
- Use the Service while suspended or after account termination
- Attempt to circumvent payment requirements or subscription limitations
6.11 Enforcement and Consequences
Our goal is to keep the Service reliable and safe for everyone. If we reasonably and in good faith believe that your use of the Service violates these Terms or creates a risk for other users, the Service, or the Company, we may take one or more of the following steps, depending on the severity and frequency of the issue:
- Notify you and ask you to correct the issue
- Temporarily limit certain features or apply additional rate limits
- Suspend your account or access while we investigate
- In serious or repeated cases, terminate your account or access
- Report clearly illegal activity to law enforcement where required or appropriate
- Decline refunds for accounts closed due to serious or repeated violations, to the extent permitted by applicable law
We may also implement additional automated protections, such as rate limiting or access restrictions, for accounts or IP addresses showing persistent abuse patterns.
Uploaded content: We reserve the right to delete any uploaded image or file without notice or explanation if our automated systems flag it as potentially violating these Terms. There is no appeal process for uploaded content deletions.
CSAM Reporting: If we discover content that appears to be child sexual abuse material, we are legally required to report it to the National Center for Missing & Exploited Children (NCMEC) and may report it to law enforcement. We will comply with these obligations without prior notice to the user. This is not optional — it's the law, and it's the right thing to do.
6.12 Good Faith Standard
The Acceptable Use Policy in this Section 6 cannot cover every possible misuse of the Service. Even if an activity is not explicitly listed as prohibited, if we reasonably and in good faith determine that your use of the Service:
- Harms or materially threatens the safety of our users, staff, or the public
- Is clearly inconsistent with the spirit and purpose of these Terms
- Creates significant legal, security, operational, or reputational risk to the Company
- Materially interferes with the normal operation of the Service
We may take appropriate steps, including restricting or terminating your access, to protect other users, the Service, and the Company.
6.13 Reporting Violations
Users can report violations by emailing abuse@momor.ai with details of the suspected violation. We will investigate all reports and take appropriate action.
6.14 Publicity and Disparagement
We welcome honest feedback, including criticism. This section is about intentionally false or staged content that misleads people about how the Service works.
You agree not to:
- Publish or promote statements you know to be false or materially misleading about the Service, the Company, or our employees
- Stage, fabricate, or heavily edit interactions with the Service in ways that materially misrepresent its behavior for the purpose of generating negative publicity or harassment
- Coordinate or participate in campaigns that rely on false or fabricated claims to damage the Company's reputation
You acknowledge that this kind of conduct can cause harm that may not be adequately addressed by monetary damages alone, and agree that we may seek appropriate injunctive or other equitable relief, including, where permitted by law, without posting a bond, in addition to any other remedies available.
Nothing in this section limits your right to:
- Share honest opinions or experiences with the Service
- Raise genuine concerns with regulators or oversight bodies
- Participate in legal proceedings
- Exercise any rights that cannot be waived under applicable law.
7. Content and Intellectual Property
7.1 Search Results
The Service provides access to third-party content. We do not own or control this content and are not responsible for its accuracy, completeness, or legality.
7.2 AI-Generated Content
AI-generated summaries may contain errors or inaccuracies. You should not rely solely on AI-generated content for critical decisions.
7.3 Your Content
Feedback and other submissions: By submitting feedback or other content to the Service, you grant us a limited, non-exclusive, revocable, worldwide, royalty-free license to host, store, and use that content solely to operate, maintain, and provide the Service features you use, and to fix bugs and ensure security.
Uploaded images and files: When you upload an image or file for visual search or analysis, you grant us a limited, temporary license to store the file in private cloud storage, share a time-limited URL with our AI providers for processing, and use the content solely to return your search results. This license terminates when the file is deleted (typically within 30 minutes, at most 24 hours).
Saved conversation threads: When you choose to save a conversation thread, you grant us a license to store your queries, our responses, and associated metadata (sources, timestamps, interaction steps) in your account for as long as you keep the thread. This license terminates when you delete the thread or your account. Ephemeral threads that you do not save are not stored beyond their short-lived cache period and require no license.
No training: This license does not permit us or our subprocessors to use your content (including uploads and saved threads) to train, retrain, or fine-tune machine learning models, or to build user profiles for advertising or cross-site tracking.
Important: Uploaded content is processed by third-party AI providers. Do not upload content you would not want processed by external systems, such as confidential business documents, privileged legal materials, sensitive personal information, or trade secrets. Once you upload something, you cannot unilaterally prevent it from being processed.
7.4 Copyright Infringement
We respect intellectual property rights and will respond to valid DMCA takedown notices.

7.5 Repeat Infringer Policy
We will terminate accounts of users who repeatedly infringe intellectual property rights.
7.6 Counter-Notifications
If you believe content was wrongly removed, you may submit a DMCA counter-notification to legal@momor.ai containing:
- Your physical or electronic signature
- Identification of the removed content
- Statement under penalty of perjury that removal was mistaken
- Your contact information
- Consent to jurisdiction in your federal district court
8. Automated Decision-Making and Content Filtering
8.1 AI Content Filtering
We use automated AI systems to:
- Block certain search queries that violate our Acceptable Use Policy or applicable laws
- Filter and rank search results to remove harmful, illegal, or policy-violating content
- Assess content for compliance with our terms and community standards
- Screen uploaded images and files for prohibited content
8.2 AI Service Providers
We engage only third-party AI providers that explicitly commit to not using customer API data for training or improvement of their models. We regularly review our AI vendors and will discontinue relationships with any provider found to be using customer content for training purposes. All providers must: (a) delete transient inputs/outputs within commercially reasonable periods; and (b) restrict use to providing the Service to us. We regularly review and publish a list of such subprocessors (see Subprocessors section).
8.3 Significant Effects
These automated decisions may significantly affect your use of the Service by:
- Preventing you from searching for certain terms or topics
- Removing or deprioritizing search results
- Limiting access to specific types of content
- Rejecting or deleting uploaded images or files
8.4 Content Moderation Appeals
General Rule: Automated filtering decisions are presumed final. To protect the integrity of our safety systems, we generally do not provide detailed explanations for specific filtering choices.
Limited Appeal for Registered Users: Registered users who believe a query was incorrectly filtered may submit a single appeal per incident to appeals@momor.ai. Appeals must include:
- The approximate date and time of the filtered query
- A general description of what you were trying to search for
- Why you believe the filter was incorrect
We will review appeals within 14 business days. Our decision on appeal is final. Abuse of the appeals process (including repeated frivolous appeals) may result in loss of appeal rights or account suspension.
No Appeals for Uploaded Content: Decisions to delete uploaded images or files are final and not subject to appeal.
No Guarantees: Appeal review does not guarantee reinstatement of filtering decisions, and we are not obligated to explain our reasoning.
8.5 Filtering Limitations
Our automated systems may occasionally:
- Block legitimate searches due to false positives
- Miss harmful content that should be filtered
- Apply inconsistent standards across similar content
We continuously work to improve filtering accuracy while balancing user access and safety.
9. Data Protection and User Rights
9.1 Data Subject Rights
Users have rights regarding their personal data as described in our Privacy Policy, including access, correction, deletion, and portability. Exercise these rights by contacting privacy@momor.ai.
9.2 Consent Withdrawal
Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of processing before withdrawal.
9.3 Underage Users
If we discover a user is under 13 (through self-disclosure, parental notification, or other means), we will promptly delete their account and associated data.
9.4 International Users
Regardless of location, all users receive the same data protection rights and service levels.
10. Subprocessors
We use vetted subprocessors to provide the Service. We maintain a current list at momor.ai/subprocessors and will provide at least 30 days' notice of material additions or replacements. You may object on reasonable, documented privacy grounds within 14 days of notice. Objections must specify the particular privacy concern and how it affects you. If we cannot resolve your objection, you may terminate any paid subscription without penalty and receive a pro-rated refund. Pretextual objections made for purposes other than genuine privacy concerns do not trigger refund rights.
Enterprise customers may restrict which subprocessors and AI providers handle their data through their Enterprise Agreement. Where such restrictions are in place, we will not route enterprise data to excluded providers.
11. Third-Party Services and Content
11.1 Search Data Providers
We use third-party services (including but not limited to web search APIs) to provide search results. We do not control or guarantee:
- The availability of these services
- The accuracy or completeness of results
- The legality of indexed content
- The continued availability of any specific search result
11.2 AI Service Providers
We use third-party AI services for generating summaries, analyzing content, and processing uploaded images and files. These AI services may:
- Produce inaccurate or misleading information
- Generate content that appears plausible but is factually incorrect
- Reflect biases present in their training data
- Be unavailable or modified without notice
- Fail to correctly identify objects, people, text, or other content in uploaded images
11.3 No Endorsement
The appearance of any content in search results or AI summaries does not constitute our endorsement of such content.
12. Paid Services
12.1 Subscription Terms
- Paid subscriptions are billed on a recurring basis
- Prices are subject to change with 30 days notice
- Refunds are provided only as required by law
- Your subscription tier, usage limits, and included features are described on our pricing and product pages, which are incorporated by reference into these Terms and may change over time.
Section 13 describes additional circumstances where we may offer a pro-rated refund if we materially reduce or discontinue a paid Service.
12.2 Payment Processing
Payment processing is handled by third-party providers. By subscribing, you agree to their terms of service.
12.3 Subscription Cancellation
How to Cancel
You may cancel your paid subscription at any time:
- If you subscribed directly through Momor: Via your account billing settings at momor.ai (or another URL we may specify in the Service).
- If you subscribed through a third-party platform (such as the Apple App Store or Google Play): Through that platform's subscription management tools. We cannot cancel subscriptions purchased through third-party platforms on your behalf.
When Cancellation Takes Effect
Cancellation takes effect at the end of your current billing period. When you cancel:
- you will not be charged for future billing periods,
- you will retain access to paid features until the end of your current paid period, and
- your account may automatically revert to the applicable free tier after your paid period ends.
Canceling a subscription does not automatically delete your account; you may delete your account at any time as described in Section 4.2.
Refunds Subscription fees already charged are non-refundable except:
- where required by applicable law, or
- where Section 13 provides a pro-rated refund (for example, if we materially reduce or discontinue a paid Service for reasons not caused by your breach).
12.4 Payment Disputes and Chargebacks
You agree to contact us at billing@momor.ai before initiating any chargeback or payment dispute with your payment provider. Chargebacks or payment disputes initiated in bad faith, or without first attempting to resolve the issue with us, may result in:
- Immediate suspension or termination of your account
- Forfeiture of any data or content associated with your account
- Collection efforts for all amounts owed, including reasonable collection costs and attorneys' fees to the extent permitted by law
- Being barred from creating future accounts
We reserve the right to dispute any chargeback we believe to be fraudulent or made in bad faith.
13. Service Modifications and Discontinuation
We may modify, suspend, or discontinue the Service—or any plan, tier, or feature—at any time.
13.1 Notice for Material Changes to Paid Plans
For changes that materially reduce core functionality of a paid tier you subscribe to—including discontinuation of that tier—we will:
- Provide at least 30 days' notice where reasonably possible, via email or in-product notification
- Offer a pro-rated refund of any prepaid, unused subscription fees
We may provide less notice, or act without advance notice, where required by law, for security reasons, or due to circumstances beyond our reasonable control.
13.2 Your Options
If you do not agree to a material change to your paid plan, you may cancel your subscription before the change takes effect. Upon cancellation under these circumstances, you will receive a pro-rated refund of any prepaid, unused subscription fees.
13.3 Termination of Paid Access for Non-Breach Reasons
If we terminate your paid subscription or access for reasons not caused by your violation of these Terms—such as discontinuing the Service or your subscription tier—we will:
- Provide at least 30 days' notice where reasonably possible
- Provide a pro-rated refund of any prepaid, unused subscription fees
14. Export Controls and Legal Compliance
14.1 Export Restrictions
You may not access or use the Service:
- From any U.S. embargoed countries or territories
- If you are on the U.S. Treasury Department's Specially Designated Nationals list
- If you are on the U.S. Commerce Department's Denied Persons List or Entity List
- If you are subject to any other applicable restricted party lists
14.2 Legal Compliance
We may comply with governmental, court, and law enforcement requests relating to your use of the Service. We reserve the right to report information to law enforcement when required by law or to prevent harm.
14.3 Future Transparency Reporting
As we grow, we commit to publishing annual transparency reports detailing government requests, legal process, and our responses. Until we reach sufficient scale to justify this overhead, users may request aggregate statistics by emailing legal@momor.ai.
15. Data Caching and Temporary Storage
We temporarily cache search results and web content to improve performance. Cached content is encrypted at rest, and automatically deleted within one hour. Cache content is never used for analytics beyond basic performance metrics and is never used to train models.

We do not guarantee the accuracy, reliability, or completeness of search results or AI-generated summaries. Users should independently verify important information.
16.3 Third-Party Content
We are not responsible for third-party websites or content accessed through our Service.
16.4 Harmful Content
Despite our efforts to filter harmful content, the Service may display results containing:
- Inaccurate or misleading information
- Content that some users find offensive
- Outdated or cached content
- Malicious websites or downloads
We are not liable for any harm resulting from accessing such content.
16.5 Professional Advice
Search results and AI summaries are not a substitute for professional advice (legal, medical, financial, etc.). Always consult qualified professionals for important decisions.
16.6 High-Risk Information Warning
FOR MEDICAL, LEGAL, FINANCIAL, OR SAFETY-CRITICAL INFORMATION: Do not rely on search results or AI summaries. The Service is not designed or intended for use in high-risk activities where incorrect information could lead to death, personal injury, property damage, or financial loss. Any use of the Service for such purposes is at your own risk.
16.7 Visual Search and Upload Accuracy
We do not guarantee the accuracy of visual search results, reverse image search, object identification, text extraction, or any other analysis of uploaded images or files. AI systems may misidentify content, fail to detect relevant information, or produce incorrect results. Do not rely on visual search for critical decisions.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER, EXCEPT FOR AMOUNTS THAT CANNOT BE LIMITED BY LAW. THIS CAP DOES NOT APPLY TO OUR BREACH OF CONFIDENTIALITY OR PRIVACY OBLIGATIONS STEMMING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
18. Indemnification
You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your violation of applicable laws or regulations
- Your infringement of any third-party rights
- Content you submit to the Service, including uploaded images and files (but excluding routine text search queries processed in accordance with these Terms)
- Your unauthorized or illegal use of the Service
- Your usernames, profiles, or account information
- False, misleading, or defamatory public statements about the Company, Service, or its employees
- Claims arising from your staged, fabricated, or misrepresented interactions with the Service
This indemnification does not apply to: (a) claims arising solely from the Service's display of search results or our provision of the Service in accordance with these Terms; (b) our sole negligence or willful misconduct; or (c) data breaches caused by our security failures.
For clarity regarding uploads: You are responsible for ensuring you have the right to upload any image or file you submit. If you upload content that infringes someone else's copyright, trademark, privacy rights, or other rights, and that results in a claim against us, that's on you.
19. Governing Law and Disputes
19.1 Governing Law
These Terms are governed by the laws of Illinois, United States, without regard to conflict of law principles. If you are a consumer resident of a jurisdiction with mandatory consumer protection laws, this section does not deprive you of mandatory protections.
19.2 Dispute Resolution; Arbitration
You and the Company agree to resolve disputes exclusively through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Small claims court claims are permitted. You may opt out of this arbitration provision by sending an email to legal@momor.ai within 30 days of accepting these Terms.
19.3 Class and Representative Action Waiver; Mass Arbitration
Arbitrations must proceed on an individual basis; class, collective, and representative actions are not permitted. If 25 or more similar claims are filed by or with the same counsel within 90 days, AAA's mass arbitration protocols will apply, including staged, batched proceedings and reasonable fee-shifting consistent with AAA rules. Nothing in this section limits any non-waivable rights under applicable law.
20. Changes to Terms
We may update these Terms. For material changes, we will give at least 30 days' prior notice via email or in-product notice. Continued use after the effective date constitutes acceptance. If you do not agree, you may terminate your account before the effective date and receive a pro-rated refund for any prepaid unused period.
21. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
22. Entire Agreement
These Terms, along with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and the Company regarding the Service.
23. Definitions
Personal Information: Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.
Sell/Share: As defined under the California Consumer Privacy Act and analogous state laws.
Contextual Advertising: Advertising based on the content being viewed, without using personal information or cross-site tracking.
AI Provider: Third-party services that provide artificial intelligence or machine learning capabilities.
Subprocessor: Third-party service providers that process personal information on our behalf.
De-identified Data: Information that cannot reasonably identify, relate to, describe, be capable of being associated with, or be linked, directly or indirectly, to a particular individual.
Commercially Reasonable Timeframes: Generally within 30 days for routine deletions, or longer periods where technical, legal, or operational constraints require extended processing.
Uploaded Content: Images, files, or other materials you upload to the Service for visual search, reverse image search, or file analysis.
24. API and Programmatic Access
24.1 Current State
Automated or programmatic access to the Service is not permitted without express written authorization. Enterprise customers may obtain API access under a separate Enterprise Agreement and API Terms of Service.
24.2 API Access
API access, whether through an enterprise agreement or a future public offering, is governed by separate API Terms of Service. API users are required to:
- Register for and securely maintain API credentials
- Comply with published rate limits and usage policies
- Not share, sell, or transfer API credentials
- Not use API access to build competing services, training datasets, or benchmarks without written permission
- Accept responsibility for all activity under their API credentials
24.3 Reservation of Rights
We reserve the right to deny, suspend, or revoke API access at our sole discretion, and to modify API terms, pricing, and availability at any time.
